Rule 243
During the pandemic, delivery services saw a huge boom in trade.
While the rest of the country was on lockdown, businesses that offered delivery saw a huge increase in sales.
If your business was able to cash in then you know how vital your fleet is to the success of your company. But, what you might not know is there are very strict rules on where your drivers can park during a delivery.
In January new updates to the highway code saw the introduction of a new hierarchy on the roads and stricter rules around phone use. One long-standing rule that was also updated in January is often missed by drivers.
Rule 243 gives very clear guidance on where a driver can park and where they can’t. Stopping in one of these areas, even for a short time, could see you landed with a £100 fine. The update to this rule gives more priority to pedestrians and cyclists in line with the new safety hierarchy.
Where can’t I park?
You cannot park in these areas:
- a school entrance
- anywhere you would prevent access for Emergency Services
- a bus or tram stop or taxi rank
- a level crossing or tramway crossing
- opposite or within 10 meters (32 feet) of a junction
- near the brow of a hill or hump bridge
- opposite a traffic island
- on a lowered curb
- in front of an entrance to a property
- on a bend
- obstructing cycle facilities
But the rules state what a should ‘not do’ rather than what they ‘must do’.
From a legal perspective, this change in language takes the rules from being enforceable to being guidance.
Although it isn’t illegal to park in any of the places outlined by rule 243, the local authorities could issue a Parking Charge Notice.
It’s a good idea to get used to these rules now as councils will gain more power around parking rules later this year.
The rule also states that a driver should stop unless forced to by traffic flow. This means that if you are stuck in a traffic jam in any of these areas you won’t face any action.
